1. Acceptance of Terms

By accessing or using Hayy ("the Service"), operated by Aberkane Software House FZ-LLC ("we", "us", "our"), a company registered in the United Arab Emirates, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Service. We reserve the right to update these terms at any time, and your continued use constitutes acceptance of any changes.

2. Description of Service

Hayy is an online directory providing informational content about residential communities in Dubai, United Arab Emirates. The Service includes community profiles, amenity listings, map-based exploration, and user features such as favourites and search. All community information is provided for general informational purposes only.

3. User Accounts

You may create an account using Google OAuth. You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to provide accurate information and to notify us immediately of any unauthorised use. We reserve the right to suspend or terminate accounts that violate these terms.

4. Hayy+ Subscription

Hayy may offer a paid subscription plan ("Hayy+") with additional features. Payments are processed securely by Stripe.

  • Subscriptions are billed on a recurring basis (monthly or annually) unless cancelled before the next billing cycle.
  • You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.
  • Refunds are handled on a case-by-case basis. Contact us at support@aberkane.io for refund requests.
  • We reserve the right to change subscription pricing with reasonable notice.

5. User Conduct

You agree not to misuse the Service. This includes, but is not limited to:

  • Using the Service for any unlawful purpose or in violation of UAE law.
  • Attempting to gain unauthorised access to any part of the Service.
  • Scraping, data mining, or using automated tools to extract content without our written consent.
  • Submitting false, misleading, or abusive content through contact forms or any other feature.

6. Intellectual Property

All content, design, text, graphics, and software on Hayy are the property of Hayy or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. Community information, including amenities, distances, and ratings, is provided for general reference only and may not be accurate, complete, or up-to-date. We do not guarantee the accuracy of any listing and recommend verifying details independently before making decisions.

8. Limitation of Liability

To the fullest extent permitted by UAE law, Hayy and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability for any claim shall not exceed the amount you have paid us in the twelve months preceding the claim.

9. Governing Law

These Terms shall be governed by and construed in accordance with the federal laws of the United Arab Emirates. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

10. Changes to Terms

We may revise these Terms at any time by updating this page. The "Last updated" date at the top will reflect the most recent revision. We encourage you to review this page periodically. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
